Terms of Service

1. Acceptance of Terms

By accessing or using AECify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AECify is an AI-powered construction inspection and project management platform for the Architecture, Engineering, and Construction (AEC) industry. The Service includes features for digital inspections, project management, document management, bidding, compliance monitoring, and team collaboration.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You are responsible for all activities that occur under your account
  • You must be at least 16 years old to use the Service

4. Subscription and Payment

  • The Service is offered on a subscription basis with seat-based licensing
  • Payment is processed securely through Stripe
  • Subscription fees are billed in advance on a monthly or annual basis
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Refunds are handled on a case-by-case basis — contact support@aecify.com
  • We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other users' data or accounts
  • Interfere with or disrupt the Service's infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or extract data from the Service
  • Share your account credentials with unauthorized parties
  • Use the Service to store or transmit content that infringes intellectual property rights

6. Your Data

  • You retain ownership of all data you upload to the Service ("Your Data")
  • You grant us a limited license to process Your Data solely to provide the Service
  • We will not access Your Data except as necessary to provide the Service, prevent abuse, or comply with law
  • You can export Your Data at any time using the self-service export feature
  • Upon account deletion, Your Data will be permanently removed as described in our Privacy Policy

7. AI Features

The Service includes AI-powered features for photo analysis, code compliance, and document analysis. These features are provided as tools to assist professionals and should not be relied upon as the sole basis for compliance, safety, or construction decisions. You remain responsible for verifying all AI-generated outputs.

8. Security

We implement industry-standard security measures to protect Your Data, including encryption, access controls, and regular security audits. We maintain a SOC 2 compliance program. However, no method of electronic transmission or storage is 100% secure. You are responsible for maintaining the security of your account credentials and enabling multi-factor authentication where available.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance, updates, or security reasons. We will provide reasonable notice of planned maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, AECify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AECify from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through an in-app notification at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration.
